Wills, Probate, Tax and Trusts and Elderly clients

We often put off making a Will – even solicitors – but it is very any unwise to do this or to try to make a home made will.

Those who die without making a will are intestate and have their property divided amongst their relatives in accordance with a statutory formula that may well not coincide with their wishes.
Those who make home made wills often end up with a will that is either invalid or unclear and therefore the cause of costly disputes between relatives.

It is much better to instruct us and we will advise about aspects that may not have occurred to you including tax planning, and then draft a will that gives full effect to your wishes on your death. A Will is a very personal and important document and is deserving of time and careful consideration in drafting.

We also advise elderly clients and their relatives about Lasting Powers of Attorney, eligibility for Local Authority or NHS funding for continuing care and upon the various alternatives available. We can challenge unfair care home contracts and check that local authority assessments are correct.

We also deal with Probate and Administration of Estates, making sure that all the assets are accounted for – dealing with the Revenue and ensuring that the correct Inheritance , Income and Capital Gains tax is paid and that the estate is distributed in accordance with the Will or rules of intestacy.
